1. About these terms

These terms of service (the “Terms”) govern your use of the website at trinityhawk.com (the “Site”). Please read them carefully before you use the Site. By accessing or using the Site you confirm that you accept these Terms and agree to comply with them. If you do not agree, please do not use the Site.

The Site is operated by TrinityHawk Ltd (“TrinityHawk”, “we”, “us” or “our”), a company registered in England and Wales under company number 15048603, with its registered office at 124 City Road, London, EC1V 2NX. Our VAT number is GB479139743.

TrinityHawk operates as a single international firm. Where services are delivered in Iceland, the relevant contracting entity may be TrinityHawk ehf (kennitala 4306251360), registered at Selbrekku 24, 200 Kópavogur, Iceland. A United States contracting entity is also available where required. Any engagement with a specific entity will be confirmed in the relevant services agreement.

2. Acceptance and eligibility

The Site is intended for business users. By using the Site you confirm that you are at least 18 years old and, where you are acting on behalf of an organisation, that you have authority to accept these Terms on its behalf.

3. Changes to these terms

We may revise these Terms from time to time. The version that applies is the one published on the Site when you use it. We recommend that you check this page occasionally to note any changes, as they are binding on you.

4. Changes to the Site

We may update and change the Site from time to time to reflect changes to our services, our users’ needs and our business priorities. We do not guarantee that the Site, or any content on it, will always be available or uninterrupted. We may suspend, withdraw or restrict the availability of all or any part of the Site for business and operational reasons.

5. Acceptable use

You may use the Site only for lawful purposes. You must not:

  • use the Site in any way that breaches any applicable local, national or international law or regulation;

  • use the Site in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;

  • attempt to gain unauthorised access to the Site, the server on which it is stored, or any server, computer or database connected to it;

  • introduce any viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful;

  • attack the Site via a denial-of-service attack or a distributed denial-of-service attack;

  • collect or harvest data from the Site (including by scraping or automated means) other than as expressly permitted by us in writing; or

  • reproduce, duplicate, copy or re-sell any part of the Site in breach of these Terms.

We may report any breach of these provisions to the relevant authorities and cooperate with them by disclosing your identity where required.

6. Intellectual property rights

We are the owner or the licensee of all intellectual property rights in the Site and in the material published on it, including text, graphics, logos, the TrinityHawk name and brand, page layouts, and downloadable materials. Those works are protected by copyright, trade mark and other laws and treaties around the world. All such rights are reserved.

You may print off one copy, and may download extracts, of any page from the Site for your own internal business reference. You must not modify the paper or digital copies of any materials you have printed or downloaded, and you must not use any illustrations, photographs, video or audio sequences, or any graphics, separately from any accompanying text.

You must not use any part of the content on the Site for commercial purposes without obtaining a licence to do so from us. If you print off, copy or download any part of the Site in breach of these Terms, your right to use the Site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

7. Information on the Site is not advice

The content on the Site is provided for general information only. It is not intended to amount to advice on which you should rely. Nothing on the Site constitutes professional, legal, financial or commercial advice, and no client or advisory relationship is created by your use of the Site.

Although we make reasonable efforts to keep the information on the Site up to date, we make no representations, warranties or guarantees, whether express or implied, that the content on the Site is accurate, complete or current. You should obtain professional or specialist advice before taking, or refraining from taking, any action on the basis of content on the Site.

8. Our services are provided under a separate agreement

The Site describes the services offered by TrinityHawk, including fractional revenue leadership, strategic sales consultancy, HubSpot and CRM consultancy, and founder sales advisory. Any description of our services on the Site is for general information and does not form part of any contract.

Where you engage TrinityHawk to provide services, those services are governed by a separate written agreement between you and the relevant TrinityHawk entity. These Terms govern only your use of the Site and do not create any obligation on us to provide services or any entitlement for you to receive them.

9. Enquiries and information you submit

If you contact us through the Site, for example by using a contact form, requesting information, or booking a meeting through an embedded scheduler, you are responsible for ensuring that the information you provide is accurate and that you are entitled to share it. Do not submit confidential or sensitive information through the Site unless we have asked you to.

We handle personal data you submit in accordance with our Privacy Policy.

10. Privacy and cookies

Our use of your personal data is governed by our Privacy Policy, and our use of cookies and similar technologies is governed by our Cookie Policy. Please review both documents to understand how we collect and use your information. By using the Site you acknowledge that you have read these documents.

11. Third-party links and tools

The Site may contain links to other websites and resources provided by third parties, and may embed third-party tools such as scheduling, analytics or form services. These links and tools are provided for your information and convenience only. We have no control over the contents of those sites or resources, and we accept no responsibility for them or for any loss or damage that may arise from your use of them. The inclusion of any link or tool does not imply endorsement by us of the linked site or its operator.

12. Disclaimers

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms that may apply to the Site or any content on it, whether express or implied.

The Site is made available to you on an “as available” basis. We do not warrant that the Site will be secure or free from bugs or viruses, and you are responsible for configuring your own information technology and platform to access the Site and for using your own virus protection software.

13. Our liability

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the laws of England and Wales.

Subject to the paragraph above, and because the Site is a business-facing information resource:

  • we exclude all implied conditions, warranties, representations or other terms that may apply to the Site or any content on it;

  • we will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with use of, or inability to use, the Site, or use of or reliance on any content on the Site; and

  • in particular, we will not be liable for loss of profits, sales, business or revenue, business interruption, loss of anticipated savings, loss of business opportunity, goodwill or reputation, or any indirect or consequential loss or damage.

Nothing in this section affects the terms of any separate written services agreement between you and TrinityHawk, which will set out the liability position that applies to those services.

14. Linking to the Site

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not frame the Site on any other site. We reserve the right to withdraw linking permission without notice.

15. Events outside our control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by any act or event beyond our reasonable control.

16. Governing law and jurisdiction

These Terms, their subject matter and their formation, are governed by the law of England and Wales. You and we both agree that the courts of England and Wales will have exclusive jurisdiction over any dispute or claim arising out of, or in connection with, these Terms or your use of the Site.
